What This Means (2025 FDD)

According to Itan's 2025 Franchise Disclosure Document, franchisees must treat all operational and customer data relating to their salon as confidential. Itan owns all ideas, improvements, inventions, marketing materials, operational data, and customer data related to the salon.

This means that while Itan franchisees are granted the right to use this data during the term of their Franchise Agreement, they do not own it. Franchisees must comply with all applicable data protection laws and Itan's data processing and data privacy policies as outlined in the Manual. This includes safeguarding the data and using it only for the purposes of developing, marketing, and operating the Itan salon in accordance with the Franchise Agreement and Manual.

Franchisees are only allowed to disclose confidential information to their employees on a need-to-know basis, and all employees (excluding general managers) must sign a Confidentiality Agreement before being granted access to this information. Franchisees must promptly inform Itan if they discover any unauthorized use of proprietary information or copyrighted materials. Itan is not obligated to act but will respond as they deem appropriate.

In practical terms, this means an Itan franchisee must implement robust data security measures, train employees on data protection policies, and adhere strictly to Itan's guidelines for data usage. Failure to comply with these requirements could result in a breach of the Franchise Agreement and potential legal consequences.
