What This Means (2025 FDD)

According to Itan's 2025 Franchise Disclosure Document, Itan franchisees must identify their salons through the use of service marks, trademarks, trade names, and logos that Itan designates and authorizes for use. These identifiers, referred to as "Marks," include iTAN®, iTAN SUN SPRAY SPA®, and associated logos.

In practical terms, this means an Itan franchisee is required to use the specific branding elements provided by Itan to ensure uniformity and recognition across all franchise locations. This extends to any distinctive trade dress, which encompasses the visual elements that identify a salon or its products. The Itan System includes distinctive interior and exterior design, décor, signage, color scheme and other trade dress elements.

This requirement is typical in franchising, as it helps maintain brand consistency and customer recognition. Franchisees must adhere to these branding guidelines to ensure that their salon aligns with the overall brand image of Itan. This also means that franchisees need to get Itan's approval prior to using any marks to identify their salon.

Failure to comply with these branding requirements could result in a breach of the franchise agreement, potentially leading to penalties or termination of the franchise agreement. Therefore, it is crucial for prospective franchisees to understand and adhere to Itan's branding guidelines as outlined in the franchise agreement and brand standards manual.
