What is the Itan franchised business referred to as in the Franchise Agreement?

Itan Franchise · 2025 FDD

Answer from 2025 FDD Document

If we award you a franchise, you must sign the form of franchise agreement attached to this Disclosure Document as EXHIBIT "C" (the "Franchise Agreement"). We refer to the franchised business you purchase as your "Business" or your "Salon". The Franchise Agreement grants you a license to use certain service marks, trademarks, trade names and logos, including the service marks iTAN® and iTAN SUN SPRAY SPA® (collectively, the "Marks"). The Marks also include our distinctive trade dress used to identify a Salon or the products it sells. The Franchise Agreement also grants you a license to use the system we developed for the operation of a Salon (the "System"). Our confidential Brand Standards Manual (the "Manual") describes the operational aspects of a Salon. You will operate your Salon as an independent business using the Marks, the System, the information in the Manual, and the support, guidance and other methods and materials we provide.

What This Means (2025 FDD)

According to Itan's 2025 Franchise Disclosure Document, the franchised business that a franchisee purchases is referred to as a "Business" or a "Salon" in the Franchise Agreement. The Franchise Agreement grants the franchisee a license to use Itan's service marks, trademarks, trade names, and logos, including the service marks iTAN® and iTAN SUN SPRAY SPA®. It also grants a license to use the system developed for operating a Salon.

This means that when a franchisee signs the Franchise Agreement, the document will refer to their Itan franchise location as either a "Business" or a "Salon". The franchisee will operate their location as an independent business, utilizing Itan's trademarks, the System, and the information provided in the Brand Standards Manual.

It is important for prospective franchisees to understand that the Franchise Agreement is a legally binding document that outlines the terms and conditions of the franchise relationship. The agreement grants the franchisee the right to operate an Itan business using Itan's established brand and system, but it also imposes certain obligations on the franchisee, such as adhering to Itan's standards and paying royalties.
