What are some examples of 'Marks' that Itan authorizes Salons to use?

According to Itan's 2025 Franchise Disclosure Document, the 'Marks' encompass service marks, trademarks, trade names, and logos that Itan designates and authorizes its salons to use. Examples of these Marks include "iTAN®", "iTAN SUN SPRAY SPA®", and their associated logos. The Marks also extend to any distinctive trade dress that identifies an Itan salon or the products it sells.

For a prospective Itan franchisee, this means they are licensed to use these specific brand identifiers to operate their salon. However, this use is strictly controlled and must adhere to Itan's guidelines. Unauthorized use of these Marks constitutes an infringement of Itan's rights, and franchisees must comply with all provisions in the Manual governing the use of Intellectual Property.

Itan retains the right to change the Intellectual Property, including the Marks, at any time. Franchisees are responsible for implementing these changes at their own expense and are not entitled to compensation for any losses incurred due to these changes, including loss of goodwill associated with a Mark. Franchisees must use the Marks as the sole identification of their salon, while also identifying themselves as the independent owner in a prescribed manner. They are also prohibited from using the Marks in any modified form or as part of a corporate or trade name without explicit authorization.
