What This Means (2025 FDD)
According to Itan's 2025 Franchise Disclosure Document, all notices and notifications under the Franchise Agreement must be in writing and delivered by specific methods. These methods include hand delivery, registered or certified air mail with postage prepaid and return receipt requested, special delivery service (such as Federal Express, DHL, or UPS), or email.
The notice should be sent to the franchisee's address as specified in Part A of ATTACHMENT "A" of the Franchise Agreement. For Itan, notices should be sent to iTAN Franchising, Inc. at 1784 La Costa Meadows Dr., #101 San Marcos, California 92078, Attention: Chief Executive Officer, with a copy sent via email to Faraje@itan.com. The franchisor can change their address with 10 days prior notice.
The FDD specifies when a notice is considered to be given. If delivered by hand, notice is deemed given on the date of delivery. If sent by mail or special delivery, it is considered given on the third business day after being sent. If sent by email, notice is considered given on the first calendar day after sending. This ensures clarity and documentation of when official communication is received, which is crucial for adhering to deadlines and obligations under the agreement.
