What This Means (2025 FDD)
According to the 2025 Itan Franchise Disclosure Document, the definition of 'Marks' does include logos. The FDD specifies that 'Marks' encompasses all service marks, trademarks, trade names, and logos that Itan designates and authorizes its salons to use. Examples provided in the document include iTAN®, iTAN SUN SPRAY SPA®, and their associated logos.
This definition is important for prospective franchisees because it clarifies what intellectual property Itan protects and licenses to its franchisees. Franchisees are permitted to operate under these marks and use them in their business.
The definition of 'Marks' also extends to any distinctive trade dress used to identify an Itan salon or the products it sells. This means that the overall look and feel of the salon, including its design and visual elements, are also protected under the 'Marks'.
As a franchisee, it is critical to adhere to Itan's guidelines for using these marks to maintain brand consistency and avoid any potential legal issues related to trademark infringement. Franchisees should familiarize themselves with the specific logos, trade names, and trade dress elements that Itan designates for use to ensure compliance.
