Answer from 2025 FDD Document

  • C. You desire to acquire an iTAN franchise for purposes of converting your Current Business to an iTAN Salon and we are willing to grant you the right and obligation to do so.
  • D. Concurrently with the execution of this Addendum, the Parties are entering into an iTAN Franchise Agreement (the "Franchise Agreement"), pursuant to which we will grant you the right and obligation to convert the Current Business to an iTAN Salon that operates in accordance with our System and features tanning, beauty and wellness services (e.g., FIT Bodywrap®, aqua massage, teeth whitening, salt therapy, photo light therapy and other approved services) and sells related retail items under our Marks (your "ITAN Salon").

What This Means (2025 FDD)

According to the 2025 Itan Franchise Disclosure Document, a key aspect of understanding the franchise agreement involves defining what constitutes a 'Salon'. While the document does not provide a single, consolidated definition labeled as 'Salon,' it does offer several references that collectively clarify its meaning within the context of the franchise.

Specifically, the FDD describes an Itan Salon as a business that operates in accordance with Itan's System, featuring tanning, beauty, and wellness services. These services include tanning itself, along with other offerings such as FIT Bodywrap, aqua massage, teeth whitening, salt therapy, and photo light therapy. Additionally, Itan Salons sell related retail items under the Itan Marks.

Furthermore, the FDD specifies that a 'Competing Business' does not include a Salon operated under a valid Itan franchise or license agreement. This implies that an Itan Salon is a distinct entity recognized and authorized by Itan Franchising, Inc. to provide the aforementioned services and sell related retail items under the Itan brand. This definition is crucial for franchisees as it sets the scope of their business operations and distinguishes them from potential competitors, ensuring compliance with the franchise agreement and adherence to the Itan System.
