What This Means (2025 FDD)
According to Itan's 2025 Franchise Disclosure Document, after the termination, expiration, or transfer of the Franchise Agreement, the franchisee must comply with Itan's data retention policies relating to Business Data. Additionally, the franchisee is obligated to transfer Customer Data (and, if Itan requests, assign all customer contracts) to Itan or its designee. Business Data is defined as all data pertaining to the franchisee's salon, customers, and business operations, whether collected by the franchisee, Itan, or any other person.
This means that upon leaving the Itan franchise system, franchisees must adhere to specific guidelines set by Itan regarding how long and in what manner they must retain business-related data. This includes data about salon operations, customer information, and other business activities. Furthermore, Itan has the right to request that the franchisee hand over all customer data and assign any existing customer contracts to Itan or someone Itan designates.
These post-term obligations are fairly standard in franchising, as franchisors need to maintain brand consistency and operational control. The specific data retention policies are likely detailed in Itan's confidential brand standards manual for the operation of a Salon, referred to as the Manual. A prospective franchisee should carefully review the Manual and seek clarification from Itan regarding the exact requirements for data retention and customer data transfer upon termination or transfer of the franchise agreement.
