We own all ideas, improvements, inventions, marketing materials and other concepts you develop relating to a Salon. We also own all operational and customer data relating to your Salon. You must treat this data as confidential. We license you the right to use this data during the term of your Franchise Agreement. You must comply with all applicable data protection laws and our data processing and data privacy policies in the Manual.
We provide access to our confidential information through the Manual, training programs and other periodic support and guidance. You may use this information solely for purposes of developing, marketing and operating your Salon in compliance with the Franchise Agreement and Manual. You may not disclose our confidential information to anyone other than your employees, on a need-to-know basis, without our prior permission. We consider all information in the Manual to be confidential. All your employees and representatives (other than general managers) must sign the Confidentiality Agreement attached to the Franchise Agreement as ATTACHMENT "G" before you give them access to our confidential information.
You must promptly notify us if you discover an unauthorized use of our proprietary information or copyrighted materials.

According to Itan's 2025 Franchise Disclosure Document, franchisees must comply with all applicable data protection laws and the franchisor's data processing and data privacy policies as outlined in the manual. This means that franchisees are responsible for understanding and adhering to both legal requirements and the specific guidelines set by Itan regarding how customer and operational data is handled.
Itan owns all operational and customer data related to the franchisee's salon and licenses the right to use this data to the franchisee during the term of the Franchise Agreement. The franchisee must treat all data as confidential. This includes protecting sensitive information from unauthorized access, use, or disclosure. Franchisees must also ensure that their employees are aware of and adhere to these data protection requirements, as employees will be required to sign a confidentiality agreement.
Furthermore, franchisees are required to use technology systems in accordance with the manual and comply with all associated data entry policies. They must also take necessary steps to provide Itan with independent and unlimited access to data collected through their technology systems, including gross sales data. Franchisees are responsible for protecting against computer viruses, bugs, power disruptions, and attacks by unauthorized persons, and may be required to obtain and maintain cyber insurance and business interruption insurance for technology disruptions. Itan also provides email addresses and accounts that franchisees must exclusively use for all communications related to their salon, and these email addresses and accounts remain the property of Itan.
