- **15.7.
Data Ownership & Protection.** We are the exclusive owner of all Business Data, whether collected by you, us or any other Person.
We hereby grant you a license to use the Business Data solely for purposes of operating your Salon in compliance with this Agreement.
You must protect all Customer Data with a level of control proportionate to the sensitivity of data.
You must adhere to applicable privacy Laws with respect to data which, if compromised, could have a negative impact on our image or consumer confidence.
You must comply with all applicable data protection Laws and our data processing and data privacy policies in the Manual (if any).
Upon request, you must sign any data processing or data privacy agreement required by us or by Law.

What This Means (2025 FDD)
Based on the 2025 Itan Franchise Disclosure Document, the franchisor, iTAN Franchising, Inc., retains exclusive ownership of all Business Data, irrespective of who collects it, whether it's the franchisee, the franchisor, or any other party. However, Itan grants the franchisee a license to utilize this Business Data solely for the purpose of operating their salon in compliance with the franchise agreement.
The franchisee is obligated to protect all Customer Data with a level of control that is proportionate to the sensitivity of the data. This means that more sensitive data requires stricter protection measures. Franchisees must also adhere to all applicable privacy laws concerning data, especially data which, if compromised, could negatively impact Itan's brand image or erode consumer confidence.
Furthermore, franchisees must comply with all applicable data protection laws and Itan's data processing and data privacy policies as outlined in the brand standards manual. Upon request, franchisees are required to sign any data processing or data privacy agreement mandated by Itan or by law. This multifaceted approach ensures that while franchisees have access to business data for operational purposes, Itan maintains control over the data's ownership and sets stringent standards for its protection and use.
