According to Itan's 2025 Franchise Disclosure Document, the franchise agreement addendum may be executed in counterparts, each of which is considered an original. All counterparts together form a single document. The parties involved, which include Itan Franchising, Inc. as the franchisor and the franchisee, must execute the agreement to indicate their acceptance of the terms. The agreement becomes effective as of the date written on the agreement. If the franchisee is a business entity, the type of entity must be specified.
For a prospective Itan franchisee, this means that the franchise agreement does not necessarily require all parties to sign the same physical document at the same time. Instead, separate copies can be signed and later compiled to form the complete agreement. This provides flexibility, especially when parties are geographically separated. The franchisee should ensure that all counterparts are properly executed and collected to avoid any potential disputes regarding the agreement's validity.
It is also important to note that if the area developer is a business entity, each person holding equity interest in the developer entity, including their spouses, must sign a Franchise Owner Agreement concurrently with the execution of the agreement.
