What This Means (2025 FDD)
According to Itan's 2025 Franchise Disclosure Document, the Development Schedule is described in Section 4.1 of the development agreement and Part C of ATTACHMENT "A". This schedule outlines the plan for developing the Required Salons within the Development Territory.
The franchisee is obligated to develop, open, and operate all Required Salons as listed in the Development Schedule, adhering strictly to the opening dates specified. It's important to note that the opening date in the Development Schedule may be earlier than what is required in the associated Franchise Agreement; the franchisee must meet the Development Schedule's dates even if they are sooner.
If a Force Majeure event prevents the franchisee from opening a Required Salon by the date in the Development Schedule, an extension may be granted per Section 13.5, for a reasonable time considering the nature of the event, but not exceeding 180 days. The franchisee also confirms they have independently assessed the viability of the Development Schedule and acknowledge that breaching it constitutes a material breach of the agreement.
