Grand Opening Advertising Campaign (Franchise Agreement 4.8)
You must spend at least $5,000 to conduct a grand opening advertising campaign to promote the opening of your Hyper Kidz Business. Your grand opening campaign must include the elements we require, such as direct mail campaigns and giveaways. We must approve of your grand opening advertising campaign, and your campaign must be conducted in the period that includes 12 weeks before and 12 weeks after opening of your Hyper Kidz Business.
We reserve the right to collect some or all of your grand opening funds and/or your Local Advertising expenditure and implement grand opening campaign activities and/or Local Advertising on your behalf.

What This Means (2024 FDD)
According to Hyper Kidz's 2024 Franchise Disclosure Document, franchisees are required to spend a minimum of $5,000 on a grand opening advertising campaign. This campaign must include elements required by Hyper Kidz, such as direct mail campaigns and giveaways. The campaign period spans 12 weeks before and 12 weeks after the opening of the Hyper Kidz Business. Hyper Kidz must approve the grand opening advertising campaign.
Hyper Kidz retains the right to collect some or all of the franchisee's grand opening funds and/or local advertising expenditure to implement grand opening campaign activities and/or local advertising on the franchisee's behalf. Additionally, Hyper Kidz will consult with franchisees to develop the grand opening advertising campaign.
This means that while franchisees are responsible for funding and initially developing their grand opening campaign, Hyper Kidz has significant control over the campaign's content and execution. Franchisees must obtain approval from Hyper Kidz for their advertising campaign, and Hyper Kidz can take over the implementation of the campaign using the franchisee's funds. This level of franchisor involvement is common in the franchise industry, as it allows the franchisor to maintain brand consistency and ensure effective marketing strategies are used across all locations.
