What This Means (2024 FDD)

According to Hyper Kidz's 2024 Franchise Disclosure Document, Hyper Kidz does not mandate that the General Manager or any other personnel possess an ownership stake in the franchise. The decision to grant ownership interest to the General Manager is entirely at the franchisee's discretion. However, if the franchisee or one of their Principals is not involved in the daily operations, the General Manager must commit their full time and effort to managing the Hyper Kidz business. Hyper Kidz retains the right to communicate with and depend on the General Manager's decisions in such cases.

Hyper Kidz stipulates that the General Manager must be approved by them and must successfully complete the initial training program. If a replacement of the General Manager is necessary, the new appointee must also gain Hyper Kidz's approval and complete the initial training program within 30 days of starting their role, with the franchisee bearing the associated costs.

Even if the franchisee is not actively involved in the daily operations, they or one of their Principals must still complete the initial training program. They must also ensure that the Hyper Kidz business adheres to the Franchise Agreement, the Manual, and the System. The General Manager is expected to be qualified, complete the training program to Hyper Kidz's satisfaction, and pass a screening test. Hyper Kidz may also require confidentiality and non-competition agreements from the General Manager and other key employees.
