Answer from 2024 FDD Document

Under the Multi-Unit Development Agreement, you must establish at least three Hyper Kidz Businesses within the Development Area according to a minimum performance schedule, and sign a separate Franchise Agreement for each Hyper Kidz Business established under the Multi-Unit Development Agreement. The Franchise Agreement for the first Hyper Kidz Business opened under the Multi-Unit Development Agreement will be in the form attached as Exhibit B to this Disclosure Document and will be signed at the same time you sign the Multi-Unit Development Agreement. For each additional Hyper Kidz Business developed under the Multi-Unit Development Agreement, you must sign the form of Franchise Agreement that we are then offering to new franchisees which may differ from the current Franchise Agreement. The size of the Development Area will vary depending upon local market conditions and the number of Hyper Kidz Businesses to be developed.

What This Means (2024 FDD)

According to Hyper Kidz's 2024 Franchise Disclosure Document, a Multi-Unit Development Agreement requires the franchisee to establish a minimum of three Hyper Kidz businesses within a defined Development Area. This agreement grants the franchisee the right to open multiple Hyper Kidz locations within a specific geographic region. The Development Area's size is determined by the franchisor based on local market conditions and the number of Hyper Kidz businesses planned for development.

Under the Multi-Unit Development Agreement, a franchisee must adhere to a minimum performance schedule for opening these locations. A separate Franchise Agreement is required for each Hyper Kidz business established under the development agreement. The Franchise Agreement for the first location is signed concurrently with the Multi-Unit Development Agreement, while subsequent locations will use the then-current Franchise Agreement, which may differ from the original.

For prospective franchisees, this means committing to a larger scale operation from the outset. It offers the potential for greater market penetration and brand recognition within the Development Area, but also requires significant capital investment and operational capabilities to manage multiple locations simultaneously. Franchisees should carefully consider their financial resources, management expertise, and market knowledge before entering into a Multi-Unit Development Agreement with Hyper Kidz.
