We do not impose any other restrictions in the Franchise Agreement or otherwise, as to the goods or services that you may offer or sell or as to the customers to whom you may offer or sell, except as described in Item 12.

What This Means (2024 FDD)

According to Hyper Kidz's 2024 Franchise Disclosure Document, Hyper Kidz does not generally impose restrictions on the customers to whom a franchisee may offer or sell, except as described in Item 12 of the FDD.

Specifically, while Hyper Kidz franchisees can sell products and services to customers who live anywhere but choose to use their franchised business, they are restricted in engaging in promotional activities or sales through the internet, except for party bookings made through the Hyper Kidz website. Franchisees are also limited in using catalogs or other mail order devices, or telephonic communications directed to customers outside of their designated territory.

Hyper Kidz franchisees cannot make sales or deliver products to customers outside their designated territory if a Hyper Kidz Business is already in operation in that area. Furthermore, franchisees are prohibited from directly soliciting customers outside of their designated territory and from selling any products at wholesale. These restrictions aim to protect the territorial rights of other franchisees and maintain the integrity of Hyper Kidz's distribution channels.
