Can a Hyper Kidz franchisee sue Hyper Kidz for losses sustained as a result of modifications to the System?

According to the 2024 Hyper Kidz Franchise Disclosure Document, Hyper Kidz retains the right to modify its System to adapt to changes in technology, market conditions, and consumer trends. These modifications may include changes to products, programs, services, methods, standards, forms, policies, and procedures. Hyper Kidz can also alter building design, equipment, signage, and even the brand's trademarks. While franchisees must comply with these changes, Hyper Kidz states that these changes should not materially and unreasonably increase the franchisee's obligations.

Hyper Kidz explicitly states that it will not be liable for any expenses, losses, or damages a franchisee incurs due to these modifications. The franchise agreement includes a covenant where the franchisee agrees not to initiate or participate in any legal action against Hyper Kidz or any third party, seeking compensation for losses or damages resulting from system modifications.

Furthermore, the franchisee expressly waives any claims, demands, or damages related to these modifications.
