Hyper_Kidz Franchise · 2024 FDDAnswer from 2024 FDD Document
We can refuse to renew your franchise if your lease, sublease or other document by which you have the right to occupy the Site is not extended before your successor term is to take effect to cover the period of the renewal or if you do not have a written commitment from your landlord to renew the lease or sublease for a period at least equal to the successor term. We may also refuse to renew your franchise under other circumstances, including, but not limited to, your failure to substantially comply with the terms of this Agreement, your failure to pay amounts owed to us when due, or your failure to cure of any defaults incurred during the initial term of this Agreement, if applicable.

What This Means (2024 FDD)
According to Hyper Kidz's 2024 Franchise Disclosure Document, a franchisee's lease agreement plays a crucial role in the renewal of their franchise. Hyper Kidz can refuse to renew a franchise agreement if the franchisee's lease or sublease for the site is not extended to cover the renewal period. Alternatively, Hyper Kidz may refuse renewal if the franchisee does not have a written commitment from the landlord to renew the lease or sublease for a period at least equal to the successor term.
This stipulation means that franchisees must proactively manage their lease agreements to ensure they align with the franchise agreement's renewal terms. Securing a lease extension or a written commitment for renewal well in advance of the successor term is essential. Failure to do so can result in Hyper Kidz refusing to renew the franchise, regardless of the franchisee's compliance with other terms of the agreement.
Beyond lease-related issues, Hyper Kidz retains the right to refuse renewal under other circumstances, including failure to comply with the franchise agreement, failure to pay amounts owed, or failure to cure defaults incurred during the initial term. This underscores the importance of maintaining good standing with Hyper Kidz throughout the franchise term to ensure renewal eligibility. Franchisees should consider the lease renewal terms as a critical component of their overall compliance strategy.
