What This Means (2024 FDD)
According to the 2024 Hyper Kidz Franchise Disclosure Document, franchisees are explicitly restricted from using the "Hyper Kidz" name or any confusingly similar name in a URL without permission. Hyper Kidz reserves the right to manage all internet and electronic commerce activities related to the system, including establishing and maintaining websites.
This means that a franchisee cannot independently create a website or URL that incorporates the Hyper Kidz brand name to promote their specific location without express consent from the franchisor. Hyper Kidz may, however, provide a "click through" subpage on their corporate website for individual franchise locations. If Hyper Kidz offers this subpage, franchisees must regularly provide updated content as specified by Hyper Kidz.
This policy ensures brand consistency and allows Hyper Kidz to control its online presence and marketing efforts. It is a fairly standard practice in franchising, where franchisors seek to maintain uniform brand messaging and customer experience across all locations. Franchisees must adhere to these guidelines and obtain approval for any online promotional activities to avoid violating the franchise agreement.
