What This Means (2024 FDD)
According to the 2024 Hyper Kidz Franchise Disclosure Document, Hyper Kidz is restricted from employing anyone who is currently employed by a Hyper Kidz franchisee. Specifically, during the term of the Franchise Agreement, Hyper Kidz cannot directly or indirectly employ or attempt to employ any person who is employed by the franchisee or any entity controlled by the franchisee. Furthermore, Hyper Kidz is prohibited from inducing any such person to leave their employment without the franchisee's prior written consent. This clause protects the franchisee's investment in their employees and ensures that Hyper Kidz will not poach trained staff from its franchisees.
This provision is designed to maintain a clear separation between the employees of the franchisee and the franchisor. It reinforces the independent contractor relationship between Hyper Kidz and its franchisees. This prevents potential conflicts of interest and labor disputes that could arise if Hyper Kidz were to directly employ individuals working for its franchisees.
For a prospective Hyper Kidz franchisee, this clause offers some assurance that the franchisor will not compete for their employees. This can be a significant benefit, as hiring and training employees can be a substantial investment for the franchisee. Requiring written consent before employing a franchisee's employee gives the franchisee control over their staffing and reduces the risk of losing valuable team members to the franchisor.
