What constitutes a 'Domain Name' in connection with a Hyper Kidz Business?

According to Hyper Kidz's 2024 Franchise Disclosure Document, a Domain Name is defined as the internet domain name selected or used in connection with a Hyper Kidz Business. This also includes any other domain names that may be utilized by Hyper Kidz or which Hyper Kidz may authorize the franchisee to use.

Hyper Kidz maintains control over internet and electronic commerce activities pertaining to the Hyper Kidz system. Hyper Kidz may establish one or more websites accessible through URLs and may provide a "click through" subpage on their website for the promotion of a franchisee's Hyper Kidz Business. Franchisees must routinely provide updated content for their subpage. Hyper Kidz reserves the right to specify the content, frequency, and procedure for updating this subpage.

As a Hyper Kidz franchisee, you are not allowed to maintain your own website or advertise on the internet in connection with your Hyper Kidz Business. Nor can you establish a link to any website Hyper Kidz establishes. You are also prohibited from establishing any other website or URL that incorporates the "Hyper Kidz" name or any name confusingly similar to the Hyper Kidz marks. Additionally, franchisees are not permitted to promote their Hyper Kidz Business or use any of the marks on social media websites without prior consent from Hyper Kidz.

Upon termination or expiration of the franchise agreement, Hyper Kidz has the authority to obtain all of the franchisee's rights to internet listings, domain names, internet advertising, websites, listings with search engines, email addresses, social media, or any other similar listing related to the franchised business. The franchisee must also assign to Hyper Kidz or terminate any website that identifies them as associated with Hyper Kidz, as well as terminate any domain name of such website.
