What constitutes a 'Competitive Business' in relation to a Hyper Kidz franchise?

According to Hyper Kidz's 2024 Franchise Disclosure Document, a 'Competitive Business' is defined as any business, other than the franchised Hyper Kidz Businesses, that shares a similar character and concept to a Hyper Kidz Business. This includes businesses offering the same or substantially similar products and services.

During the term of the Multi-Unit Development Agreement, franchisees and their principals are prohibited from owning, maintaining, advising, helping, investing in, making loans to, being employed by, engaging in, or having any interest in such a Competitive Business, unless they obtain written approval from Hyper Kidz. This restriction applies to any business operated by the franchisee prior to entering into the agreement as well.
