What This Means (2024 FDD)
According to the 2024 Hyper Kidz Franchise Disclosure Document, a Collateral Assignment of Lease is not always required. Hyper Kidz must approve the lease for the franchisee's proposed site. The FDD states that at Hyper Kidz's request, the franchisee must have their landlord sign a Collateral Assignment of Lease.
This means that whether a Collateral Assignment of Lease is required depends on Hyper Kidz's discretion. A prospective franchisee should clarify with Hyper Kidz under what circumstances they would request this assignment.
Understanding the conditions under which Hyper Kidz requires a Collateral Assignment of Lease is essential for a prospective franchisee. This knowledge allows the franchisee to anticipate potential negotiations with the landlord and prepare accordingly. It also provides insight into Hyper Kidz's risk management strategies and their relationship with the leased property.
