What This Means (2025 FDD)
According to Hydrodog's 2025 Franchise Disclosure Document, the guarantor, in consideration of Hydrodog signing and delivering the Franchise Agreement, agrees to be personally bound by all obligations, restrictions, and covenants within the agreement. This means that if the business entity (the franchisee) fails to meet its obligations, the guarantor is personally liable for those failures.
Specifically, the guarantor is jointly and severally guaranteeing that the business entity will punctually pay and perform every obligation and obey every restriction and covenant set forth in the Franchise Agreement. This includes, but is not limited to, financial obligations like royalty payments and adherence to operational standards detailed in the agreement.
For a prospective Hydrodog franchisee, this requirement means that if you operate your franchise through a business entity, you (and potentially your spouse or other owners with significant equity) must personally guarantee the franchise's performance. This is a common practice in franchising, as it provides the franchisor with additional security and recourse in case of default by the franchisee. It's crucial to carefully review the entire Franchise Agreement to fully understand the scope of these obligations and restrictions before signing the Owner's Guaranty.
