Can Hydrodog terminate the agreement if the franchisee or their personnel fail to complete initial training successfully?

16.2 By Us. Subject to applicable state law and any required notice and cure periods mandated by state franchise laws, we have the right to terminate this Agreement, effective upon delivery of written notice of termination to you, if:
- (c) you or the required number of your personnel fail to successfully complete initial training to our satisfaction or you have not fulfilled all of the conditions for management of your HydroDog Business described in this Agreement;
7.4 Completion of HydroDog Academy. Successful completion of HydroDog Academy, any other initial training and any additional or extended initial training we require before opening is a condition to the opening of your HydroDog Business to the public.
You must at all times faithfully, honestly, and diligently perform your contractual obligations. System Standards may regulate the staffing levels and employee qualifications, training, dress, and appearance of your HydroDog Business. Any Designated Owner or General Manager must complete the mandatory training to our satisfaction.
- 7.2 Initial Training Fee. We will provide our HydroDog Academy training as stated herein. At the time you sign this Agreement, you must pay us a five thousand dollar ($5,000) nonrefundable initial training fee (the "Initial Training Fee") per trainee in consideration of the pre-opening initial training program that we will conduct for you. You are responsible for all expenses and costs that you incur for training or attending conferences, including wages, travel and living expenses.
We may require additional training if you or your staff fail to meet our then-current performance or compliance standards.
If we require or you request, and we agree to provide, additional training or assistance, which may be conducted on-site (in Territory), online, at our location, or at another location we designate, you must pay our then-current fee for additional training (the "Additional Training Fees") plus all travel and living expenses for each trainer (the "Training Expenses"), regardless of training location.

What This Means (2025 FDD)
According to Hydrodog's 2025 Franchise Disclosure Document, Hydrodog has the right to terminate the Franchise Agreement if the franchisee or the required number of their personnel fail to successfully complete the initial training to Hydrodog's satisfaction. This termination is effective upon delivery of written notice.
Successful completion of the HydroDog Academy, any other initial training, and any additional or extended initial training that Hydrodog requires before opening is a condition for opening the Hydrodog Business to the public. The franchisee must also ensure that any Designated Owner or General Manager completes the mandatory training to Hydrodog's satisfaction. If a replacement Designated Owner or General Manager is needed, they must also complete the mandatory training to Hydrodog's satisfaction before being employed.
Prospective franchisees should consider the implications of failing to meet Hydrodog's training standards. The initial training fee is $5,000 per trainee and is nonrefundable. The franchisee is responsible for all expenses and costs incurred for training, including wages, travel, and living expenses. Hydrodog may also require additional training if the franchisee or their staff fail to meet performance or compliance standards, incurring further costs for additional training fees and expenses.
