What This Means (2025 FDD)
According to Hydrodog's 2025 Franchise Disclosure Document, Hydrodog retains significant discretion in granting approvals and consents. Except where expressly stated otherwise in the agreement, Hydrodog has the absolute right, in its sole discretion, to refuse any request from a franchisee or to withhold approval of any action or omission. This broad right gives Hydrodog considerable control over various aspects of the franchise operation.
This provision means that franchisees must obtain Hydrodog's approval for many actions, and Hydrodog is not obligated to grant such approval. This could affect a franchisee's ability to make changes to their business, adopt new strategies, or respond to local market conditions. The FDD also states that even if Hydrodog provides any waiver, approval, consent, or suggestion, or delays or denies a request, it will not be deemed to have made any warranties or guarantees, nor will it assume any liability or obligation to the franchisee.
For a prospective Hydrodog franchisee, this underscores the importance of carefully considering the terms of the franchise agreement and understanding the extent to which Hydrodog's approval is required for various business decisions. It also highlights the need to assess Hydrodog's track record in working with franchisees and to seek clarification on any areas where the franchisee may want more autonomy. Franchisees should be prepared to justify their requests for approval and to accept that Hydrodog may not always grant them.
This level of franchisor control is not uncommon in the franchise industry, as franchisors often seek to maintain consistency and protect their brand standards. However, prospective franchisees should carefully evaluate whether they are comfortable with the degree of control that Hydrodog retains and how it might impact their ability to operate their business effectively.
