What This Means (2025 FDD)
According to the 2025 HydroDog FDD, as a franchisee, you must provide the notices of trademark and service mark registrations that HydroDog specifies. Additionally, you are responsible for obtaining any fictitious or assumed name registrations that may be required by applicable law. This means HydroDog will instruct you on the specific wording or symbols to use to indicate their trademarks and service marks are registered, ensuring consistent branding and legal protection across all franchise locations.
This requirement ensures that HydroDog's intellectual property is properly protected and that customers are aware of the trademarks and service marks associated with the brand. Failing to comply with these requirements could lead to legal issues for both the franchisee and HydroDog. It is common practice in franchising to require franchisees to use specific notices to protect the brand's trademarks and service marks.
Furthermore, if there is any apparent infringement or challenge to your use of any HydroDog mark, or any claim by any person of any rights in any mark, you must notify HydroDog immediately. You are not allowed to communicate with anyone other than HydroDog, their attorneys, and your attorneys regarding any infringement, challenge, or claim. HydroDog has the sole discretion to take action and the right to control any litigation or administrative proceeding relating to any mark.
