What This Means (2025 FDD)
According to Hydrodog's 2025 Franchise Disclosure Document, the Non-Compliance Fee does not replace other remedies that Hydrodog has under the Franchise Agreement. The Non-Compliance Fee is in addition to all other rights and remedies Hydrodog has.
The Non-Compliance Fee is incurred if a franchisee fails to comply with Hydrodog's system standards and requirements. The fee is $250 for the first instance of non-compliance for which written notice is given, $500 for the second, and $750 for the third and subsequent instances.
This fee is only charged if the franchisee fails to correct the non-compliance within the given cure period. Even if the franchisee pays the Non-Compliance Fee, Hydrodog still retains all other rights and remedies available under the Franchise Agreement, including the right to terminate the franchise for repeated or uncured violations. This means that Hydrodog can pursue other actions, such as legal remedies or termination of the agreement, in addition to collecting the Non-Compliance Fee.
