What are the 'Marks' that Hydrodog uses, promotes, and licenses?

According to Hydrodog's 2025 Franchise Disclosure Document, the company uses, promotes, and licenses certain trademarks, service marks, and commercial symbols, which they collectively refer to as the "Marks". The FDD specifically identifies the trade and service mark "HydroDog" as one of these marks, along with other associated logos, designs, and commercial symbols.

As a Hydrodog franchisee, your right to use these Marks is derived solely from the franchise agreement and is limited to operating your HydroDog Business in strict accordance with the agreement and all System Standards. Unauthorized use of the Marks constitutes a breach of the agreement and infringes upon Hydrodog's rights. The agreement emphasizes that any goodwill established through your use of the Marks benefits Hydrodog exclusively, and the agreement does not confer any goodwill or other interests in the Marks to you, other than the right to operate under the agreement.

The agreement also places limitations on how you can use the Marks. You must use them as the sole trade identification of your HydroDog Business, while also identifying yourself as the independent owner in a manner acceptable to Hydrodog. You are prohibited from using any Mark or variation of it in several ways, including as part of any corporate or legal business name, with unauthorized prefixes or suffixes, in selling unauthorized services or products, as part of any domain name or electronic address, or in any manner not expressly authorized in writing.

Furthermore, you are required to display the Marks prominently and exclusively as prescribed by Hydrodog at your business, and on all forms, advertising, and digital platforms. You must also provide notices of trademark and service mark registrations as specified by Hydrodog and obtain any necessary fictitious or assumed name registrations. You are obligated to notify Hydrodog immediately of any apparent infringement or challenge to your use of any Mark and must cooperate in protecting Hydrodog's interests in any related legal proceedings.
