What This Means (2025 FDD)

According to the 2025 Hydrodog FDD, the franchise agreement outlines several instances where a franchisee may be in default and specifies conditions under which these defaults can be cured. The Hydrodog operations manual contains mandatory and suggested specifications, standards, operating procedures, and rules, referred to as System Standards, that Hydrodog prescribes for the operation of a Hydrodog Business. These standards are subject to periodic modifications and updates, and franchisees are responsible for monitoring any online or electronic versions of the manuals for changes.

Specifically, the FDD mentions that if a franchisee violates any health, safety, or sanitation law, ordinance, or regulation, they must cure the non-compliance or violation within the time period required by the entity issuing the violation. Additionally, if a franchisee fails to make payments of any amounts due to Hydrodog or its affiliates, they have ten days after written notice to correct such failure.

Furthermore, if Hydrodog determines, following an inspection, that a Hydrodog Business's or Hydrodog Vehicle's appearance, equipment, signs, or decor does not meet the System Standards, the franchisee will receive written notification of the necessary corrective actions. The franchisee then has thirty days to take all steps needed to correct the deficiencies. Failure to correct deficiencies within this cure period may result in a non-compliance fee. The FDD states that the operations manual may contain further details about these and other potential defaults and the specific steps required to cure them.

It is important for prospective Hydrodog franchisees to carefully review the operations manual and franchise agreement to fully understand their obligations and the procedures for curing any defaults. Franchisees should also maintain open communication with Hydrodog to address any concerns and ensure compliance with all standards and requirements.
