What This Means (2025 FDD)
According to Hydrodog's 2025 Franchise Disclosure Document, a 'Competitive Business' is defined broadly. It includes any business or facility that is involved in owning, operating, managing, granting, selling, offering, or supporting franchises or licenses to others. This encompasses businesses that provide pet grooming, pet care, pet products, or services through mobile, fixed, internet, or catalog-based operations.
Essentially, any business offering pet-related products and services that are identical, similar, competitive with, or substitutable for Hydrodog's offerings falls under this definition. However, the definition specifically excludes any Hydrodog Business operating under a franchise agreement with them. Hydrodog also retains the discretion to determine if any other business is considered competitive.
This definition is important for prospective franchisees because it outlines the scope of activities they are restricted from engaging in, both during the franchise term and for a period afterward, as detailed in the 'Competitive Restrictions' section of the franchise agreement. Understanding this definition is crucial for avoiding potential conflicts of interest and ensuring compliance with the franchise agreement.
