Is acquisition of the HydroDog Vehicle a condition of opening my HydroDog business?

an 9-months after receipt of the previous HydroDog Vehicle.
You may not open your HydroDog Business for business until: (1) we approve your HydroDog Business as developed according to our specifications and standards; (2) training has been completed to our satisfaction; (3) the Franchise Fee has been paid to us, subject to state law; (4) the HydroDog Vehicle has been acquired; (5) the Initial Tools Package has been received; (6) we have approved the managers of your HydroDog Business if you are a Business Entity, and you have demonstrated to our satisfaction that the pre-opening conditions of the Franchise Agreement have been met; (7) we have been furnished with copies of all required insurance policies, or such other evidence of insurance coverage and payment of premiums we request; (8) we have received signed counterparts of all required documents pertaining to your acquisition of the HydroDog Vehicle. (Franchise Agreement, Section 5.8) You obtain our approval for and open your HydroDog Business within 30 days after receipt of your HydroDog Vehicle, unless there are unforeseen circumstances or factors beyond your control, in which case an extension may be granted at our discretion. (Franchise Agreement, Section 5.1) We may terminate the Franchise Agreement if you fail to open in the time required, unless an extension has been granted. (Franchise Agreement, Section 16.2)
Post-Opening Obligations: During your operation of your HydroDog Business, we will:
- Advise you from time to time regarding the operation of your HydroDog Business based on reports you submit or inspections we make.

What This Means (2025 FDD)
According to Hydrodog's 2025 Franchise Disclosure Document, acquiring a HydroDog Vehicle is a condition for opening your HydroDog business. Specifically, you may not commence business operations until the HydroDog Vehicle has been acquired. The FDD states that if you own multiple territories, you are not required to purchase all HydroDog Vehicles at the time of signing your franchise agreement. However, you must acquire each vehicle through HydroDog or its approved suppliers no later than 9 months after receiving the previous HydroDog Vehicle.
Furthermore, after receiving your HydroDog Vehicle, you are expected to obtain approval for and open your HydroDog Business within 30 days. Extensions may be granted at HydroDog's discretion if there are unforeseen circumstances or factors beyond your control. Failure to open within the required timeframe, without an approved extension, may result in the termination of the Franchise Agreement.
In addition to acquiring the HydroDog Vehicle, several other conditions must be met before opening your HydroDog Business. These include obtaining HydroDog's approval of your business setup, completing training to HydroDog's satisfaction, paying the Franchise Fee, receiving the Initial Tools Package, securing approval for business managers (if applicable), providing copies of required insurance policies, and furnishing signed documents related to the HydroDog Vehicle acquisition.
