When can construction begin for a Hear Again America franchise?

You may not begin construction until we have given you written approval of the plans and we or the Project Manager has approved in writing your choice of general contractor.
We may require you to use only general contractors that we have pre-approved, provided that one is available in your Site Selection Area. (Franchise Agreement - Sections 4.5(c)).

What This Means (2025 FDD)
According to the 2025 Hear Again America FDD, construction on a Hear Again America franchise location cannot begin until two conditions are met. First, Hear Again America must provide written approval of the franchisee's submitted construction plans. Second, Hear Again America or their Project Manager must provide written approval of the franchisee's choice of general contractor.
Hear Again America also retains the right to mandate that franchisees exclusively use pre-approved general contractors, assuming such a contractor is available within the franchisee's designated Site Selection Area. The franchisee bears the responsibility for ensuring that the chosen contractor is appropriately licensed within their jurisdiction and maintains adequate insurance coverage.
Prior to making any binding commitments to purchase, lease, or sublease a site, Hear Again America must provide written approval of the proposed lease or purchase agreement, including any letters of intent. Hear Again America may also require the franchisee to engage an attorney to review the lease or purchase agreement and provide documentation confirming the agreement's terms align with any prior letters of intent. While Hear Again America reviews the lease, this is solely for their benefit and franchisees are strongly encouraged to seek independent legal counsel for their site lease review and negotiation.
