Can the Site Selection Area be modified during the term of the Healthsource Chiropractic Development Agreement?

The Site Selection Area may not be modified at any time during the term of the Development Agreement unless the parties mutually agree to the modification in a separate signed writing.
Once you have secured a Premises for a given Clinic to be developed per your Development Agreement, we will grant you a Protected Area around that Clinic as described above. Once you have signed a lease for the last clinic in your development agreement, you will cease to have the rights to the Site Selection Area, and are only entitled to the protected territory granted to each individual clinic

What This Means (2025 FDD)
According to Healthsource Chiropractic's 2025 Franchise Disclosure Document, the Site Selection Area, which is assigned when entering a Development Agreement, can be modified during the term of the Development Agreement. However, this modification is contingent upon both Healthsource Chiropractic and the franchisee mutually agreeing to the change in a separate, signed written agreement.
This stipulation provides some flexibility for Healthsource Chiropractic developers. If market conditions change or a better location becomes available, the franchisee is not necessarily locked into the initially defined Site Selection Area. However, it also means that Healthsource Chiropractic must also agree to the modification, so the franchisee cannot unilaterally change the area. This requirement for mutual agreement ensures that both parties are aligned on any changes to the development plan.
Once a franchisee secures a premises for a clinic to be developed per the Development Agreement, Healthsource Chiropractic will grant a Protected Area around that clinic. After the franchisee signs a lease for the last clinic in their development agreement, they will no longer have rights to the Site Selection Area, and will only be entitled to the protected territory granted to each individual clinic.
