What This Means (2025 FDD)

According to Healthsource Chiropractic's 2025 Franchise Disclosure Document, if a Business Associate discloses PHI for the proper management and administration of the Business Associate or to carry out the legal responsibilities of the Business Associate, the Business Associate must obtain reasonable assurances from the person or entity to whom the PHI is disclosed that the information will remain confidential. This person or entity must agree to use or further disclose the information only as required by law or for the purposes for which it was disclosed to them.

Furthermore, the person or entity receiving the PHI must notify the Business Associate of any instances of which it is aware in which the confidentiality of the PHI has been breached. This ensures that all parties involved are aware of potential breaches and can take appropriate action to mitigate any harm caused by the breach.

This requirement is in place to protect patient privacy and comply with HIPAA regulations. It places a responsibility on both the Business Associate and the recipient of PHI to maintain confidentiality and report any breaches. For a Healthsource Chiropractic franchisee, this means ensuring that any third parties they share PHI with, such as legal or administrative services, are contractually obligated to protect the information and report any breaches in confidentiality.
