tion over (i) the creative concepts, materials, endorsements, and media used therein, and (ii) the geographic, market, and media placement and allocation of the programs. HealthSource Chiropractic shall have the right to determine, in its sole discretion, the composition of all geographic territories and market areas for the development and implementation of such programs. You agree that the Ad Fund may be used to pay any and all costs of maintaining, administering, directing, and preparing national, regional or local advertising materials, programs, and promotional activities, including, without limitation, (a) costs for preparing and conducting television, radio, magazine, billboard, newspaper, internet and other media programs and activities, (b) costs associated with conducting marketing research, (c) costs associated with website development and marketing, including without limitation, search engine optimization and social media, (d) administering regional and multi-regional advertising programs, including, without limitation, purchasing direct mail and other media advertising, (e) employing advertising, program and marketing agencies, and vendors providing marketing services, (f) development, implementation and maintenance of online asset management tools, (g) marketing and advertising training programs and materials, and (h) costs for providing promotional brochures and advertising templates and materials to HealthSource Chiropractic Clinic franchises. What This Means (2025 FDD)
According to the 2025 HealthSource Chiropractic Franchise Agreement, HealthSource Chiropractic has the discretion to establish, maintain, and administer an Ad Fund to support marketing and promotional programs for HealthSource Chiropractic Clinic franchises. As a franchisee, you are required to contribute to this Ad Fund. HealthSource Chiropractic has sole discretion over the creative concepts, materials, endorsements, and media used in these advertising programs, as well as the geographic, market, and media placement and allocation.
The Ad Fund may be used to cover various costs related to advertising and promotional activities. These include preparing and conducting television, radio, magazine, billboard, newspaper, and internet programs. It also covers costs associated with marketing research, website development and marketing (including search engine optimization and social media), administering regional and multi-regional advertising programs (such as direct mail and other media advertising), and employing advertising agencies and vendors.
Furthermore, the Ad Fund can be used for the development, implementation, and maintenance of online asset management tools, marketing and advertising training programs and materials, and providing promotional brochures and advertising templates and materials to HealthSource Chiropractic Clinic franchises. This means franchisees can expect to receive support in the form of various marketing materials and programs, covering both traditional and digital media, to help promote their clinics.
In addition to the Ad Fund, HealthSource Chiropractic may offer optional marketing promotions directly to the franchise's patients via email, telephone, mail, social media, or other means. If a franchisee chooses to participate in these promotions, they must confirm that their patients have given permission to be contacted for such purposes. Franchisees are also obligated to spend a minimum of $3,000 or 5% of their gross revenues (whichever is greater) on local advertising, promotion, and marketing, in addition to Ad Fund contributions and Technology Fees.
