Can I, as a Healthsource Chiropractic franchisee, use the Marks to promote any business other than my Healthsource Chiropractic Clinic franchise?

Healthsource_Chiropractic Franchise · 2025 FDD

Answer from 2025 FDD Document

You may not use any Mark as part of any corporate or trade name, or with any prefix, suffix, or other modifying words, terms, designs or symbols, or in any modified form. You also may not use any Mark with the sale of any unauthorized service, to promote any business or commercial venture other than your Clinic franchise, or in any manner we have not expressly authorized in writing. You must prominently display the Marks on or with franchise posters and displays, service contracts, stationery, other forms we designate, and in the manner we prescribe; to give any notices of trade and service mark registrations and copyrights that we specify; and to obtain any fictitious or assumed name registrations that may be required under applicable law.

What This Means (2025 FDD)

According to Healthsource Chiropractic's 2025 Franchise Disclosure Document, franchisees are explicitly prohibited from using the Marks associated with the franchise to promote any business or commercial venture other than their Healthsource Chiropractic Clinic. This restriction is in place to protect the integrity and consistency of the brand.

This means that as a Healthsource Chiropractic franchisee, you must use the Marks solely for the purpose of identifying and promoting your franchised clinic. You cannot use the Healthsource Chiropractic Marks to promote any other business you own or are involved in, ensuring that the brand's reputation is not diluted or misrepresented through association with unrelated ventures.

The FDD also states that any unauthorized use of the Marks constitutes an infringement of Healthsource Chiropractic's rights. Franchisees must adhere to the specifications, standards, and operating procedures prescribed by Healthsource Chiropractic, including the proper and authorized use of the Marks. This includes using the Marks as the sole identification of the franchise while also identifying oneself as the independent owner in the prescribed manner.

These stipulations are typical in franchising, as franchisors need to maintain tight control over their brand to ensure uniformity and protect their trademarks. Prospective Healthsource Chiropractic franchisees should understand these restrictions and ensure they are prepared to market only their franchised business using the approved Marks and methods.
