What This Means (2025 FDD)
According to Healthsource Chiropractic's 2025 Franchise Disclosure Document, the Business Associate, in this case Healthsource Chiropractic, must make Protected Health Information (PHI) in a designated record set available to the Covered Entity (the franchisee) for amendment and must incorporate any amendments to PHI accordingly. Healthsource Chiropractic must also make reasonable efforts to notify persons, organizations, or other entities, including other business associates, known by Healthsource Chiropractic to have received the erroneous or incomplete information and who may have relied, or could foreseeably rely, on such information to the detriment of the individual patient. Healthsource Chiropractic must update this information when notified by the Covered Entity.
If Healthsource Chiropractic receives a request for amendment to PHI directly from an individual patient, Healthsource Chiropractic must forward such request to the franchisee within ten business days. However, the franchisee has the sole responsibility for determining whether to approve an amendment to PHI and to make such amendment.
This means that while Healthsource Chiropractic handles the initial steps of making PHI available for amendments and notifying relevant parties, the final decision on whether to approve an amendment rests solely with the franchisee. This division of responsibility ensures compliance with HIPAA regulations while also giving the franchisee control over patient information.
