What This Means (2025 FDD)
According to the 2025 Healthsource Chiropractic Franchise Disclosure Document, when the Business Associate discloses Protected Health Information (PHI) for its own management and administration, it must ensure the information remains confidential. Specifically, the Business Associate must obtain reasonable assurances from the entity receiving the PHI that the information will be kept confidential. This means the recipient can only use or further disclose the PHI as required by law or for the purposes for which it was originally disclosed. The recipient must also notify the Business Associate if they become aware of any breaches in the confidentiality of the PHI.
This requirement ensures that Healthsource Chiropractic franchisees, acting as Covered Entities, can trust that their patients' sensitive health information is protected even when shared with the Business Associate for administrative purposes. It aligns with HIPAA regulations, which mandate the protection of PHI and hold Business Associates accountable for maintaining confidentiality.
For a prospective Healthsource Chiropractic franchisee, this means understanding the importance of HIPAA compliance and the specific obligations related to PHI. It also highlights the need to carefully vet any subcontractors or agents who may have access to PHI, ensuring they also agree to maintain confidentiality and adhere to HIPAA regulations. The franchisee should also have procedures in place to monitor and address any potential breaches of confidentiality, as they are ultimately responsible for protecting their patients' information.
