What This Means (2025 FDD)
According to Hck Hot Chicken's 2025 Franchise Disclosure Document, a franchisee operating a Non-Traditional Restaurant must use the location exclusively for that purpose during the term of the agreement. The franchisee is not permitted to relocate the Non-Traditional Restaurant within the host facility during the agreement's term. The 'Location' is strictly limited to the physical area within the Host Facility occupied by the Non-Traditional Restaurant and cannot be defined as a geographic area or described in terms other than a specific location within the Host Facility.
This means that a Hck Hot Chicken franchisee cannot operate any other type of business from the approved location. The franchisee's business activities are restricted to the specific area designated for the Non-Traditional Restaurant within the host facility. This is a common restriction in franchise agreements to maintain brand consistency and prevent confusion among customers.
The franchisee should carefully review Attachment A to the Non-Traditional Addendum, as it identifies the approved location and facility. Hck Hot Chicken's approval of the location and host facility does not guarantee the success of the Non-Traditional Restaurant, as its success depends on the franchisee's abilities as an independent businessperson. Therefore, it is crucial for the franchisee to conduct thorough due diligence and assess the location's potential before entering into the agreement.
