ITEM 12. TERRITORY

Franchise Agreement

You may operate the HCK Hot Chicken Restaurant only at the accepted location. The accepted location for your Restaurant will be listed in the Franchise Agreement. If you have not identified an accepted location for the Restaurant when you sign the Franchise Agreement, we will amend the Franchise Agreement after you select, and we accept, the accepted location.

What This Means (2025 FDD)

According to Hck Hot Chicken's 2025 Franchise Disclosure Document, a franchisee is not guaranteed their top choice of location. The FDD states that the franchisee may not be able to obtain their top choice as their accepted location. The accepted location for the Restaurant will be listed in the Franchise Agreement. If the franchisee has not identified an accepted location for the Restaurant when they sign the Franchise Agreement, Hck Hot Chicken will amend the Franchise Agreement after the franchisee selects, and Hck Hot Chicken accepts, the accepted location.

This means that while a franchisee can propose a location, Hck Hot Chicken has the final say in approving it. This is a fairly standard practice in franchising, as franchisors want to ensure that locations meet certain criteria to maximize the potential for success. These criteria often include factors like visibility, accessibility, traffic patterns, and demographics.

It is important for prospective Hck Hot Chicken franchisees to understand that securing their preferred location is not guaranteed. They should be prepared to research and present multiple potential locations to Hck Hot Chicken for consideration. Franchisees should also inquire about Hck Hot Chicken's site selection criteria and approval process to better understand what factors will influence the franchisor's decision.
