What This Means (2025 FDD)
According to Hawthorn Suites By Wyndham's 2025 Franchise Disclosure Document, Hawthorn Suites By Wyndham may require access to the property, including guest rooms, during an audit. This means that as a franchisee, you must allow Hawthorn Suites By Wyndham's auditors to inspect all areas of the hotel, including guest rooms, as part of their audit process.
In addition to physical access, Hawthorn Suites By Wyndham can also perform audits of the Facility's books and records remotely or electronically without advance notice or your knowledge. Franchisees are obligated to ensure their staff cooperate with and assist Hawthorn Suites By Wyndham's auditors in performing any audit.
Failure to comply with audit requests or discrepancies found during the audit can lead to default. Specifically, if a franchisee refuses to admit Hawthorn Suites By Wyndham's auditors during normal business hours or fails to produce the required books and records, it constitutes a default under the agreement. Furthermore, if an audit reveals that the franchisee reported less than 97% of the Facility's Gross Room Revenues for any fiscal year, it can also trigger a default notice. This highlights the importance of maintaining accurate and transparent financial records and cooperating fully with Hawthorn Suites By Wyndham's audit procedures.
