What This Means (2025 FDD)
According to Hawthorn Suites By Wyndham's 2025 Franchise Disclosure Document, if you are constructing a new facility, you must complete construction, properly deliver the required certification, and open the facility within 30 months from the effective date of the franchise agreement.
Specifically, the FDD outlines a series of milestones with corresponding deadlines. You must provide proof of owning or leasing the location within 90 days of the effective date. Preliminary plans must be submitted within 180 days. Proof of submitting approved construction plans to governmental authorities, along with a copy of the agreement with your general contractor, is due within nine months of the effective date. Construction must commence no later than 18 months after the effective date.
Hawthorn Suites By Wyndham emphasizes that time is of the essence in meeting these obligations. However, they may, at their discretion, grant extensions for any phase of the improvement obligation. Note that granting an extension does not waive any other existing defaults at the time the extension is granted. All construction must adhere to System Standards, approved plans, and the franchise agreement. The franchisee or their general contractor must also maintain the required insurance during construction.
