Does Hawaiian Bros Island Grill provide opening assistance, and can the terms of this assistance change?

- (7) Company will provide opening assistance through its new restaurant opening assistance team in accordance with Company's then-current new Hawaiian Bros Restaurant opening assistance program, which Company may modify or terminate at any time in its discretion.
If required by Company's then-current opening assistance program, Franchisee must reimburse Company for the cost of all travel, lodging, and car rental, and a per diem allowance for meals and travel incidentals of Company's new restaurant opening assistance team incurred in connection with providing such assistance.
If Company schedules the pre-opening team to provide new restaurant opening assistance and the Franchised Restaurant experiences any delay in opening, Franchisee is required to reschedule new restaurant opening assistance based on the pre-opening team's availability at the time of the delay and Franchisee is required to reimburse Company for all costs, expenses and salaries that the pre-opening team incurs during the delay.
New restaurant opening assistance during weeks with national holidays, including the weeks of Thanksgiving, Christmas and New Year's Day will be limited and subject to the team's availability.
New restaurant opening assistance provided for openings during the week of any national holiday may
require higher wage reimbursement. All new restaurant opening assistance is subject to the preopening team's availability. The level of opening support provided by Company will be determined in accordance with the criteria established by Company from time to time and may vary depending on factors such as the number of Hawaiian Bros Restaurants Franchisee operates, the number of certified trainers Franchisee employs, and whether or not Franchisee is required to maintain a certified training restaurant under Company's then-current new Hawaiian Bros Restaurant opening assistance program.
- (b) Operational Assistance.
Company will provide the following services and assistance to Franchisee after the Franchised Restaurant opens:
- (1) A portion of Company's new Hawaiian Bros Restaurant opening assistance described in Section 6(a)(7) above may be provided after the Franchised Restaurant opens.
