What This Means (2025 FDD)

According to the 2025 Hawaiian Bros Island Grill Franchise Disclosure Document, all notices, requests, demands, waivers, and other communications required or permitted under the agreement must be in writing. These written notices can be delivered through several methods, providing flexibility and proof of delivery.

The acceptable methods for delivering notices include personal delivery, certified mail with return-receipt requested, facsimile, email, or any other means that provides evidence of delivery, attempted delivery, or rejected delivery. For email or fax, evidence of delivery is required, such as a read-receipt for email or a fax confirmation page.

Notices are considered to be given and received at the date and time of receipt, attempted delivery, or rejected delivery, assuming there is evidence of such. The FDD specifies the initial addresses for notices to Hawaiian Bros Franchising, LLC (Attention: President, located in Kansas City, MO) and to the Developer (the address on the signature page). Either party can change their notification address with at least 10 days' prior notice to the other party.
