You must obtain our approval of the site for your Restaurant before you acquire the site. Unless you qualify and we approve you or your employee to select and source your own sites given your commercial real estate and development experience, you must use a licensed real estate broker to assist you with selecting and securing a site. If we have a preferred real estate broker in your market, you must use our preferred broker. If we do not have a preferred broker in your market, we have the right to approve your real estate broker. You must also use a licensed and experienced real estate attorney to negotiate your lease for the Restaurant location and obtain our approval of the lease before you sign it. We have the right to approve your site surveyors, permit expeditors, and architectural and engineering consultants.

What This Means (2025 FDD)
According to the 2025 Hawaiian Bros Island Grill Franchise Disclosure Document, franchisees who do not qualify to select their own sites must use a licensed real estate broker to assist them in finding and securing a location. If Hawaiian Bros Island Grill has a preferred real estate broker in the market, the franchisee is required to use that broker. If there is no preferred broker, Hawaiian Bros Island Grill retains the right to approve the franchisee's choice of real estate broker.
In addition to using a real estate broker, all Hawaiian Bros Island Grill franchisees must use a licensed and experienced real estate attorney to negotiate the lease for their restaurant location. The lease is subject to approval by Hawaiian Bros Island Grill before it can be signed. Hawaiian Bros Island Grill also maintains the right to approve the franchisee's site surveyors, permit expeditors, and architectural and engineering consultants.
This process ensures that all Hawaiian Bros Island Grill locations meet the brand's standards and requirements for site selection and lease terms. By mandating the use of approved professionals, Hawaiian Bros Island Grill aims to protect its brand image and ensure that franchisees secure suitable locations with favorable lease agreements. This requirement adds an extra layer of oversight and quality control to the site selection process, which is a critical factor in the success of a franchise.
