What This Means (2025 FDD)
According to Hardees' 2025 Franchise Disclosure Document, a proposed transferee must demonstrate extensive experience in high-quality restaurant operations. Specifically, the transferee needs to show Hardees that they have experience in restaurant operations similar in character and complexity to Hardees Restaurants.
In addition to experience, the proposed transferee must meet Hardees' managerial, operational, experience, quality, character, and business standards for a franchisee. They must also have a good character, business reputation, and credit rating. The transferee's management culture must be compatible with Hardees' management culture, and they must have adequate financial resources and working capital to meet the obligations under the Franchise Agreement.
Hardees has sole discretion when deciding whether to consent to a transfer. Hardees will consider numerous factors it deems relevant. Meeting these requirements does not guarantee approval of the transfer, as Hardees retains the right to make the final decision.
