What This Means (2025 FDD)
According to Hardees's 2025 Franchise Disclosure Document, franchisees must maintain Employer's Liability insurance with limits not less than $500,000. This coverage is in addition to Workers' Compensation insurance, which must be statutory as required by law in the state or locality where the franchised restaurant operates. This insurance must also be in effect for all of the franchisee's employees who participate in any of the training programs described in Section 8 of the franchise agreement.
Hardees requires that franchisees maintain this insurance coverage throughout the term of the franchise agreement. The purpose of Employer's Liability insurance is to protect the franchisee from lawsuits filed by employees who are injured on the job but whose injuries are not covered by workers' compensation.
Hardees also stipulates that the required insurance policies must be written by an insurance company or companies satisfactory to them and comply with the standards, specifications, coverages, and limits set forth in the OPM (Operations Procedures Manual) or otherwise provided to the franchisee in writing. Hardees, and any entity with an insurable interest designated by Hardees, must be named as an additional insured in such liability policies, except for workers' compensation/employer's liability, and loss payee for property to the extent each has an insurable interest. Franchisees must provide evidence of satisfactory insurance and proof of payment to Hardees no later than 30 days prior to the scheduled opening date of the franchised restaurant, the date the franchisee takes possession of the franchised location, or the date construction commences at the franchised location, whichever occurs first.
