What This Means (2025 FDD)
According to Hardees's 2025 Franchise Disclosure Document, franchisees can expect to pay several fees in addition to the initial franchise fee. The most significant ongoing fee is the Hardee’s Advertising and promotional obligation (APO), which can be up to 7% of Gross Sales; currently, it is 5.5%. This APO is divided between the Hardee’s National Advertising Fund (HNAF), Regional Co-op, and Local Store Marketing (LSM). Currently, the HNAF is 4.25% of Gross Sales, due on the 10th of each month. The Regional Co-op, if applicable, is a minimum of 0.5% of Gross Sales, but can be increased by the co-op members. The LSM is the difference between the APO and the amounts contributed to HNAF and the Regional Co-op.
Other potential fees include interest on overdue payments, which is the maximum rate permitted by the state, not exceeding 1.5% per fiscal period. Franchisees may also incur costs for Secret Shopper and other Quality Assurance (QA) programs, with a second audit costing $211 per Restaurant (subject to annual increases not exceeding 30%). They are also responsible for all costs associated with non-cash payment systems. Additional training fees can range from $300 to $1,000, plus travel and living expenses. Franchisees may also opt to purchase other training materials, with costs that vary.
Further fees may arise from financial audits and inspections if there are deficiencies in royalty fees or advertising contributions, or if there's an understatement of Gross Sales greater than 2%. Franchisees also pay a Star University Access Fee of $14 per fiscal period. Costs also include food and safety training programs, transfer fees of $2,500 per restaurant (waived for transfers to controlled entities), indemnification for losses incurred by Hardees, and costs associated with new product and supplier testing, including a $1,500 inspection deposit.
