If you are approved as a franchisee, you can buy a franchise to develop and operate one Hardee's Restaurant at a Travel Center Location or Gas and Convenience Location (each, a "Franchised Restaurant") under a Franchise Agreement (the current form is attached as Exhibit D) or, if you and the area in which you are interested meet certain qualifications, you can buy the rights to develop multiple (at a minimum, three) Franchised Restaurants at Travel Center Locations or Gas and Convenience Locations under a Development Agreement (the current form is attached as Exhibit C).

What This Means (2025 FDD)
According to Hardees's 2025 Franchise Disclosure Document, Exhibit C contains the current form of the Development Agreement. This agreement is relevant if a prospective franchisee and the area they are interested in meet specific qualifications, allowing them to buy the rights to develop a minimum of three Hardee's Franchised Restaurants at Travel Center Locations or Gas and Convenience Locations.
This Development Agreement differs from the standard Franchise Agreement (Exhibit D), which is for operating a single Hardee's Restaurant. The Development Agreement is designed for franchisees looking to expand more rapidly within Travel Center or Gas and Convenience Center locations. These locations cater to travelers, particularly the trucking industry, or focus on non-commercial fuel service and convenience items, including freshly made foods.
For a prospective Hardees franchisee, understanding the terms and conditions outlined in the Development Agreement is crucial if they plan to develop multiple locations. This includes meeting the franchisor's qualifications for area development and adhering to the development schedule specified in the agreement. It's important to note that the Development Agreement is only applicable for Travel Center and Gas and Convenience Locations, and traditional or nontraditional locations are covered under separate disclosure documents with potentially different terms.
